Purpose and Recommended Action

This is a request for City Council to ratify the expenditure of funds for an existing purchase with ACR Contracting, Inc., in an amount not to exceed $65,000 in Fiscal Year (FY) 2016 - 17 and authorizing the City Manager to enter into a new Services Agreement with expenditure authorization in the sum not to exceed $65,000.

Background

 

Development Services Department, Building Safety Division provides public health and safety and welfare pursuant to the definition within the International Codes.

 

During the past year, the Building Safety Division received referrals from the Code Compliance Division and Glendale Police Department to investigate the conditions at 6916 W. Wanda Lynn Lane and 10033 N. 49th Drive.  Building Safety staff inspected both locations and determined the observed conditions to be imminently unsafe per the International Building Code.  Both cases were brought before a hearing officer on December 12, 2016.  The hearing officer declared 6916 W. Wanda Lynn Lane as an imminent hazard to public health, safety and welfare, with unsafe conditions that exist on the property making the property hazardous and unsafe to occupy.  The Hearing Officer's decision authorized the City of Glendale to "demolish the structure on the subject property forthwith, assess the property for the costs of such demolition, and place a lien against the subject property."  The hearing officer declared 10033 N. 49th Drive as unsafe, a public nuisance an attractive nuisance and an imminent health hazard. The City of Glendale was authorized to demolish the structure on the subject property forthwith, assesses the property for the cost of such demolition and place a lien against the subject property with the Maricopa County Recorder’s Office for the cost of such demolition.

Analysis

 

In both cases (demolition of 6916 W. Wanda Lynn Lane and demolition of 10033 N. 49th Drive) the Building Safety Division solicited bids to adhere to the demolition direction from the hearing officer.   ACR Contracting, Inc. was awarded both demolition bids, which when combined, did not exceed $50,000.  Asbestos testing is part of the demolition process.  Asbestos was found to be present at 10033 N. 49th Avenue which required additional services and costs for asbestos abatement.  ACR Contracting, Inc. provided the asbestos abatement which increased the combined total expenditures to $60,789. 

 

Staff is requesting City Council ratify the expenditure of funds with ACR Contracting, Inc. in an amount not to exceed $65,000 in Fiscal Year (FY) 2016 - 17 and to authorize the City Manager to enter into a new Service Agreement with expenditure authorization in the sum not to exceed $65,000.

 

Community Benefit/Public Involvement

 

The demolition of structures at 6916 W. Wanda Lynn Lane and 10033 N. 49th Drive removed unsafe structures creating imminent hazards in two of Glendale’s neighborhoods.  The demolition actions were conducted at the direction of a hearing officer who conducted public hearings on December 12, 2016.
